Some details from our new home warranty

We decided to remove brick from the front of our home to see exactly what was behind our brick. Areas you see taped in the front of our almost $200,000.00 home is duct tape.
Since the only to get the brick out was by chiseling, the duct tape is covering over pieces of brick.
We figured our builder, Heartland Homes, would correct our water issues, as they stated in the emails we received during our 1 year warranty period.
The change you see in the photo of our Heartland Homes home below was after our trial. 5 years after our water issues start we removed brick to see what was installed behind the brick of our home.
Our Heartland Home showing various photos of water infiltration into our brand new home.

our Heartland Home 5 years later after we remove brick and pull back vinyl siding to verify if FLASHING was installed.

Heartland Homes Pittsburgh was the builder of our brand new custom built home. Andersen Windows are installed throughout our home.
Here is the Manufacturers statement regarding FLASHING their windows. We received this informative document along with our pre-closing walk through.

This home built a few years later does have weep holes and flashing installed under the weep holes you can easily see. You have NO weep holes and I've never seen flashing on our home like the picture above.
2000 & 2003 International Building Codes both years state Flashing and Weep Holes specifications.

In the itemized list from Heartland Homes to the State Attorney Generals
office,
response #7 specifically
states
"on May 21 2004, Romesburg contacted Heartland Homes concerning moisture/water stains in his basement."
Photo at very top is 1 of our
photos from May 21 2004.
In our opinion, we see more than moisture/water
stains in the photo.
This was the start of our 5+ years of water infiltration issues.
Also read about the water in our garage and the "remedial steps"
taking care of this as well.
November 3 2006 was Heartland Homes response to the State Attorney General Office.
Photos
posted below are after
that date.
We filed the complaint against Heartland Homes Pittsburgh with the State Attorney Generals
office, after our 1 year warranty was over and none of our water infiltration issues were resolved.

After our 1 year warranty is over, we don't hear from Heartland Homes again until we file our complaint with the Better Business Bureau.
Heartland Homes never even asks us IF our water issues are resolved (our water issues are not resolved) Heartland Homes never even tells us they are done working on our water issues OR anything else.
We send a certified package to the owner of Heartland Homes Alan Gillespie and/or Marty Gillespie. After almost three weeks, we hear nothing and we go the route of the Better Business Bureau.
There are a lot of details in-between starting our complaint with the BBB and our trial, a few years later.

Read Heartland Homes Pittsburgh response above to the Better Business Bureau; "the production manager, who has seen to Mr. Romesburg's house previously concerning issues."

Important note is "the electrician found a compromised conduit which housed wiring for the breaker box that was allowing water in.

Eventually we go to trial and win the verdict.... .
We've known since day one, Damp Spots are NOT covered under Heartland Homes' Warranty.
- We are NEVER TOLD we had Damp Spots, instead we are continually told during our 1 year warranty,
they are working on our issues, period.
- Even after we file our Better Business Bureau case; Heartland Homes specifically states our they are
working with us on our "Wet Basement" issues.
- Marty Gillespie Heartland Homes Pittsburgh. During our trial December 2008, he stated he was then the President of Heartland Homes, comes to our home and introduces Craig to me, Dave Romesburg. Craig is to be our point person for our issues and Marty Gillespie
walks around our home and shows Craig what needs to be done.
- Even Heartland Homes response to the State Attorney Generals Office -
"Heartland Homes will continue to monitor the situation but believes that the remedial steps taken have ELIMINATED The Water Staining issue."
After we close on our home, 3 months later our water issues start and continue to this day in 2009, over 5
years. Heartland Homes refers to our water issues as "Wet Basement" in 2004 & 2005 multiple times.
No water issues are ever resolved.
October 17 2006
Heartland Homes starts referring to our water issues as now "DAMP SPOTS" when concluding with the BBB.
Heartland Homes response is the "Company states they performed work on customer's townhouse and this work was done as a COURTESY."
It is stated in customer's warranty that "Damp Spots on foundation walls do not constitute a wet basement."
Company further states they are not responsible for damp spots on foundation wall."
No water issues are ever
resolved.
November 3 2006 - Heartland Homes response to the State Attorney Generals Office; "Heartland Homes will continue to monitor the situation but believes that the remedial steps taken have ELIMINATED THE WATER
STAINING ISSUE."
NOTE - October 17
2006 Heartland Homes response to the Better Business Bureau is now "DAMP
SPOTS" as
opposed to "WET BASEMENT" as stated in
the
November 3 2006
Heartland Homes response to the State Attorney Generals Office is
"remedial steps
taken have
ELIMINATED THE WATER
STAINING ISSUE."
Heartland Homes never asked if our water infiltration issues were resolved during our 1 year.
Especially during the 1 year warranty like we were told they were doing.
We will continue to post tons of photos so you can see the transition, during their timeframes. We have water issues, period.
Our Structural Engineer states as such.
I've located the 2000 International
Building code, along with 2003
International Building code.
Both sets of building codes specifically
state flashing and weepholes. I will get
into that further shortly.
Even the Window Manufacturer Andersen
Windows state Andersen Windows specifically state in our 2002 document
"heading
flashing and installation flanges DO NOT take the place of standard window and door flashing...."
5 year history with water infiltration issues into our brand new Heartland Homes home. Water issues started 3 months after closing on our brand new Heartland Homes house. Heartland Homes was notified every single time we had water infiltration. As you will be
able to see in our Heartland Homes gallery; we were told they were working on our issues.
Shortly after our 1 year warranty was over, we never heard back from our new home builder Heartland Homes.
Even thought we were told Heartland Homes was working on our water infiltration issues,
we never saw any changes in the amount of water coming into our brand new Heartland Homes home, please review our photos.
We were never told about anything they were working on to correct our water issues. We were never asked if there were changes to the water infiltrating our home. Nor were we even told they were done working on the outside of our home to correct our water infiltration issues, nothing.
Heartland Homes was just gone..
Even after we sent a certified package that was signed for to the office of the owner(s)of Heartland Homes, Alan Gillespie or Marty Gillespie, we hear nothing.
See our photos and you can see there are no changes to the amount of water coming into our home.
After we filed a case with the Better Business Bureau, shortly thereafter we hear back from the builder. Marty Gillespie now President of Heartland Homes called me to discuss our issues and came to our home to see our new home issues.
I was told they would resolve our issues and I was introduced to Craig Faulkner to be the person we work with.
During our BBB case filing, this time we at least saw Heartland Homes attempting to repair our water infiltration issues.
The work Heartland Homes did was at grade level and below, nothing above grade was done for whatever reason. They did seal the lower brick on our home, that was it.
None of our water issues were ever resolved by the builder that built our Heartland Homes home.
They never resolved our water infiltration issues during our BBB case, our next step was the court system. All details are outlined in our websites:
aloveheartland.com
or
daverome.com.
We won the verdict from the Judge in our lawsuit.
We eat an additional $50,000.00+ with the brand new home we purchased once
we complete the repairs required to our Heartland Homes home.
No structural engineer has ever been to our home on behalf of or representing Heartland Homes, at any time. We were told during our 1 year warranty period, they were working on our issues. However none of our issues
were ever resolved and there was never any follow up with us regarding our water issues from Heartland Homes, period.
